Regarding partnership firm
#1
Respected Sir/Madam,

My father has a partnership firm with one of his friend. The partnership agreement stated that partnership will be valid till the death of any of the partner. Now my father has expired but I want to continue the partnership firm as his legal heir. But my father's partner is not ready for it. Is there any law by which we can force the partner to continue the partnership firm.

Best Regards,

Vaibhav Patel.

Please understand that a partnership firm is governed by the terms and conditions of the partnership deed. If the partnership deed says that the partnership firm will cease to exist on the death of any of the partner than in such case, nothing can be done except there is something specific written in the deed about continuation of the firm. For that I need to check the partnership deed in detail.

Further, as per my advice why do you want to continue the partnership firm if your father's partner is not ready. It will unnecessarily increase your trouble.
